BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned alleys located between East 40th Street and Hamill Road, and between Carondelet Avenue and Divine Avenue, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: A 15 foot wide unopened alleyway beginning on the northwest line of East 41st Street (abandoned by Ordinance No. 6231) 140 feet southwest of the intersection of the northwest line of East 41st Street with the southwest line of Divine Avenue, and extending northwest 150 feet between parallel lines, and parallel to Divine Avenue. Said alleyway separates lots 6-8 from lots 9-11, block 160, East End Land Company's Addition No. 1, as shown by plat of record in plat book 2, page 22, R.O.H.C. A 15 foot wide unopened alleyway beginning on the northwest line of East 42nd Street (abandoned by Ordinance No. 6231) 140 feet southwest of the intersection of the northwest line of East 42nd Street with the southwest line of Divine Avenue; and extending northwest 400 feet between parallel lines, and parallel to Divine Avenue, to the southeast line of said abandoned East 41st Street. Said alleyway separates lots 1-8 from lots 9-16, block 169, said East End Land Company's Addition No. 1. A 15 foot wide unopened alleyway beginning on the southeast line of said abandoned East 42nd Street 140 feet southwest of the intersection of the southeast line of East 42nd Street with the southwest line of Divine Avenue, and extending southeast 200 feet between parallel lines, and parallel to Divine Avenue. Said alleyway separates lots 1-4 from lots 13-16, block 184, said East End Land Company's Addition No. 1. A 15 foot wide unopened alleyway beginning on the southeast line of said abandoned East 41st Street 140 feet southwest of the intersection of the southeast line of East 41st Street with the southwest line of Barksdale Avenue (abandoned by Ordinance No. 6231), and extending southeast 400 feet between parallel lines, and parallel to Barksdale Avenue, to the northwest line of said abandoned East 42nd Street. Said alleyway separates lots 14 and 15, and part of lots 13 and 16, from lots 27-34, block 168, said East End Land Company's Addition No. 1. A 15 foot wide unopened alleyway beginning on the southeast line of said abandoned East 42nd Street 140 feet southwest of the intersection of the southeast line of East 42nd Street with the southwest line of said abandoned Barksdale Avenue, and extending southeast 400 feet between parallel lines, and parallel to Barksdale Avenue, to the northwest line of East 43rd Street (abandoned by Ordinance No. 6231). Said alleyway separates lots 5 and 6, from lots 9-16, block 185, and East End Land Company's Addition No. 1. A 15 foot wide unopened alleyway beginning on the southeast line of said abandoned East 43rd Street 140 feet southwest of the intersection of the southeast line of East 43rd Street with the southwest line of said abandoned Barksdale Avenue, and extending southeast between parallel lines, and parallel to Barksdale Avenue, to the northeast line of Hamill Road, the northeast line of said alleyway being some 370 feet, and the southwest line being some 358 feet. Said alleyway separates lots 10-12 from lots 21-27, and part of lot 20, block 194, said East End Land Company's Addition No. 1. A 15 foot wide unopened alleyway beginning on the southeast line of Carondelet Avenue (abandoned by Ordinance No. 6231) 154.58 feet southwest of the intersection of the southeast line of Carondelet Avenue with the southwest line of said abandoned East 41st Street, and extending southeast between parallel lines, and parallel to East 41st Street, to the southwest line of another 15 foot alleyway, the northeast line being some 629 feet, and the southwest line being some 639 feet. Said alleyway separates lots 1-13 from lots 15-26, block 168, said East End Land Company's Addition No. 1. A 15 foot wide unopened alleyway beginning on the southeast line of said abandoned Carondelet Avenue 154.58 feet southwest of the intersection of the southeast line of Carondelet Avenue with the southwest line of said abandoned East 42nd Street, and extending southeast 600 feet between parallel lines, and parallel to East 42nd Street, to the northwest line of Euterpe Avenue (abandoned by Ordinance No. 6231). Said alleyway separates lots 1-12 from lots 13-24, block 186, said East End Land Company's Addition No. 1. A 15 foot wide unopened alleyway beginning on the southeast line of said abandoned Euterpe Avenue 154.58 feet southwest of the intersection of the southeast line of Euterpe Avenue with the southwest line of said abandoned East 42nd Street, and extending southeast between parallel lines, and parallel to East 42nd Street, to the southwest line of another 15 foot alleyway, the northeast line being some 216 feet, and the southwest line being some 226 feet. Said alleyway separates lots 1-5 from lots 6-8, block 185, said East End Land Company's Addition No. 1. A 15 foot wide unopened alleyway beginning on the southeast line of said abandoned Carondelet Avenue 140.25 feet southwest of the intersection of the southeast line of Carondelet Avenue with the southwest line of said abandoned East 43rd Street, and extending southeast 600 feet between parallel lines and parallel to East 43rd Street, to the northwest line of said abandoned Euterpe Avenue. Said alleyway separates lots 1-12 from lots 13-24, block 193, said East End Land Company's Addition No. 1. A 15 foot wide unopened alleyway beginning on the southeast line of said abandoned Euterpe Avenue 140.25 feet southwest of the intersection of the southeast line of Euterpe Avenue with the southwest line of said abandoned East 43rd Street, and extending southeast between parallel lines, and parallel to East 43rd Street, to the southwest line of another 15 foot alleyway, the northeast line being some 459 feet, and the southwest line being some 469 feet. Said alleyway separates lots 1-10 from lots 11-19, block 194, said East End Land Company's Addition No. 1. Tax Map No. 168H-J-1. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The City of Chattanooga has a sewer located within said right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. Said easement beginning east of Carondelet Avenue extending southeasterly to Euterpe Avenue thence northeasterly to Barksdale Avenue thence northeasterly to Divine Avenue, as shown on attached plat. 2. Lots affected by the subject abandonments should be resubdivided. 3. The areas reserved for said sewer easements must be kept free and clear of all structures. 4. All existing easements are retained. 0C SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
